These terms apply to this website and to the client portal. An advisory engagement is governed by its own written agreement, and where that agreement and these terms disagree, the agreement wins.
What we are
Trust Financials Limited is a commercial finance advisory firm. We are not a bank, a lender, or a deposit taking institution. We do not originate, underwrite or fund credit, and we do not hold client money.
Arranging financing secured by real property in Ontario is mortgage brokering under the Mortgage Brokerages, Lenders and Administrators Act, 2006. Trust Financials Limited is not a licensed mortgage brokerage. Where a file needs that work, we prepare it and refer it to a licensed brokerage, and we tell you who before anything moves.
Nothing here is an offer of credit
Amounts, ranges, timelines and structures shown on this site are illustrative maximums and market norms. They are not a quote, a pre approval, a commitment to lend, or a promise of any outcome.
Every facility is subject to the lender's own underwriting, credit review, documentation and approval. Rates, terms, fees, amounts and eligibility vary by lender, by product and by applicant, and can change without notice. All figures are in Canadian dollars.
No guarantee of approval
We do not guarantee that any financing will be approved, that it will be approved at a particular amount, or that it will complete by a particular date. What we undertake is to assess the request honestly, prepare the file properly, approach only lenders you have approved, and tell you early if we think it will not work.
Fees
Fees are agreed in writing before any work begins and are set out in the engagement agreement. We do not charge a fee for the initial review. We do not take an advance fee from a borrower before funding.
Your obligations
- Give us accurate and complete information, including the things that are inconvenient.
- Tell us promptly if something material changes.
- Do not send documents that belong to someone else without their permission.
- Do not use this site or the portal to break the law or to attempt to gain access to anything you are not entitled to.
Portal accounts
- Accounts are personal. Do not share sign in links or let anyone else use your account.
- Sign in links are single use and expire. Sessions end after 30 minutes of inactivity and after 12 hours in any case.
- Tell us immediately if you think someone else has access to your account.
- We can suspend or close an account that is being misused, and we will tell you why.
Content and intellectual property
The text, guides, design, code and marks on this site belong to Trust Financials Limited. You may read them, print them and quote short passages with attribution. You may not republish them as your own or use them to train a competing commercial service without permission.
The guides are general information about the Canadian commercial financing market. They are not legal, accounting or tax advice and they are not advice about your particular situation.
Third party links
Where we link out to a lender, a regulator or a government programme, we do not control that site and we are not responsible for its content or its privacy practices.
Limitation of liability
To the extent the law allows, Trust Financials Limited is not liable for indirect, incidental, special or consequential loss, or for lost profit, lost opportunity or lost data, arising from the use of this website or the portal.
Nothing in these terms limits liability for fraud, for fraudulent misrepresentation, or for anything else that cannot be limited under Ontario law.
Availability
We try to keep the site and the portal available, but we do not promise uninterrupted service. Maintenance, provider outages and incidents happen. If the portal is down and something is urgent, call 416-841-8468.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction.
Changes
We can change these terms. The date at the top shows when they last changed. Continuing to use the site after a change means you accept the new version.
